Any person starting a business, or thinking about creating a logo or name for their business, should be aware of trademark law. A search to find out whether another company is already using the name or mark may be prudent to avoid investing time and money in building up public recognition of a logo or name for your product or service which another company a few years down the road may be able to order you to change. The damages from such an action can be considerable, even more than the need to hire an attorney and fend off an angry company you never heard about which is convinced that you intentionally tried to steal the goodwill they had built up in their mark.
On the other hand, registering a name or logo as a mark may not only protect your business from interference by later users but also generate an asset that may become a valuable component of your business if the business is ever sold.
