The owner of a mark (whether a trademark or a service mark) controls the right to use the mark for the particular class of goods or services that the mark represents. The owner of the mark also can prevent other people from using a similar mark if the use of the second mark creates a likelihood of confusion with the first mark in the minds of the consumers who purchase that product or service.
